UPDATE: MONDAY, NOVEMBER 17TH 2008 : 8AM
                                                       
                                                           :: ERIC VOLZ TO BE RETRIED IN NICARAGUA ::

The Nicaraguan government has just announced that Eric Volz will be retried this morning at 9am Central in the Nicaraguan Supreme Court. The announcement was a total surprise and the way in which the court is proceeding is completely illegal and politically motivated.

Newspapers in Nicaragua reported yesterday that the appellate ruling of innocence will most likely be overturned and Eric will be re-convicted for the murder of Doris Jimenez.  There is speculation that President Daniel Ortega may be using the case to provoke the U.S., since the U.S. government has expressed concerns over the status of Democracy in Nicaragua.

 Faint00 wow so it sounds to me like he had a very good alibi.  Did they ever try to say Eric hired someone to kill her.  What is Eric's relationship to Doris  00000013

Eric's relationship to Doris is they were involved at one point, but had broken up before this and had remained friends.  I'll see if I can't find some better information for you MM.

Arrest for murder
In November 2006, Doris Ivania Jim?nez, a Nicaraguan who had dated Volz, was murdered at midday in her store in San Juan del Sur, Nicaragua, a coastal town near Rivas. Volz was arrested and charged with her murder.[8] However, according to both associates and mobile phone records, Volz was at his home in Managua, which also served as the magazine headquarters, conducting meetings and business, including a conference call with contacts in Atlanta, Georgia in the United States, and telephone and Internet logs confirm this.[8] Managua is two hours' drive from San Juan del Sur.[6]

On February 14, 2007, a police officer testified that Julio Martin Chamorro Lopez, who the day of the crime was seen acting suspiciously, contacted "Rosita," an employee of Doris Ivania's boutique, and offered her $5,000 to allow the murderer into the boutique.[9] Chamorro claimed that Volz and another foreigner, whom he did not identify, participated in the murder. Mercedes Alvarado, mother of the victim, described Volz as a jealous man whom her daughter believed would kill her because of his jealousy.

Volz was arrested November 23, 2006 and charged with murder, based on the claims of a Nicaraguan man who was originally charged with the murder and later released.[6] According to Volz's attorneys, Nicaraguan prosecutors did not produce any physical evidence before or at trial.[8] Although ten witnesses supported Volz's alibi, the trial court judge, Ivette Toru?o Blanco, only permitted the testimony of three. At the conclusion of the trial, Judge Toru?o Blanco convicted Volz and sentenced him to 30 years in a Nicaraguan penitentiary.

On December 17, 2007, Volz was ordered released after an appeals court overturned the conviction. His passport and bail of $10,000 were to be returned: Volz, however, was not immediately freed because a judge failed to show up for an afternoon meeting to arrange his release. [1] Local judge Ivette Toru?o Blanco delayed signing the order releasing him.[10] On December 20, 2007, a Nicaraguan appeals court in Granada signed release papers for Volz. The release came despite a prosecutor's decision to appeal the case to the Supreme Court and despite their assertions that their appeal would stay Volz's release. Prosecutor Isolda Ibarra, who conducted the prosecution of Volz at trial, had stated earlier, "we presented the appeal, and the law is clear: that the release is suspended until the high court rules on the case." Magistrate judges in the appeals court in Nicaragua have up to 10 days to review the request for appeal.

Eric Volz's mother appeared on NBC's Today Show on Friday, December 21, 2007 petitioning the Nicaraguan government to release her son. She also received support from the White House with a speech from Condoleezza Rice.[11]

On December 21, a Nicaraguan appeals court in Granada cleared up the confusion and signed release papers for Volz. Volz left Nicaragua on Friday afternoon, said Eddie Vasquez, a spokesman for the U.S. State Department. [12

This sounds like a setup to me.  Sounds like some of his buddies did this and tried to pin the blame on Eric.  I have a problem with his video blaming this all on politic's maybe he's right but it sure puts the prosection into the spot lite to be watched  Who Knows

Yes it seemed like it was his view but if I were him I would not be instigating anything at this point.  His attorney should be making statements imo not him.
I don't see any evidence and his alibi seems to be backed up by both people and his cell pings  Who Knows

:: HEARING CONCLUDED AT 12 NOON ::

IMPORTANT ADVANCEMENT - At the last minute this morning, three Opposition Party Supreme Court Justices broke their strike and entered the court room to preside over Eric's case. This moderates the balance of political influence on the 6 judge panel. The subsitute Sandinista judges did not appear, so the final count was three judges from Ortega's Party and three judges from the political opposition. The presence of the judges from the opposition greatly improves Eric's chances of recieving an objective ruling. Eric is innocent of this crime! It is our hope that the Appellate Court verdict declaring Eric's innocence will be upheld by the Supreme Court.

The information we have received is that the judges will take 30 days to announce their decision. Three officers from the U.S. Embassy were in attendance for the hearing in an observational capacity.

Eric and his family would like nothing more than to put this case behind them. We pray for the objectivity of the judges and, ultimately, for justice to be honored in memory of Doris Jimenez.

UPDATE :: Foreigners Affected by Unrest in Nica 
Body:  Wednesday, November 19th, 2008 11:30 AM CST

The tension in Nicaragua is growing, and the international community is pressuring President Ortega to maintain institutional Democracy. Yesterday, three radio stations calling for a vote recount were looted and destroyed by Ortega's loyalists. Additionally, American baseball great Cal Ripken had his baseball camp cut short for security reasons.


** Note from Eric to Foreign Investors **
I have received some letters from Americans and other foreigners with investments and assets in Nicaragua who are concerned about the negative impact that reports from the media (including my updates to supporters) are having and will continue to have on their ability to do business. I completely understand their concerns... They are valid concerns. But I also challenge investors and travelers to consider the larger picture of not how they are being affected, but rather how the Nicaraguan people, who have lost their most basic civil liberties and peace, are being affected in the center of violence and corruption.
