Judge denies Martha Stewart sentence cut

(upi News) NEW YORK, April 11 : A New York U.S. District Judge Monday rejected Martha Stewart's request for an early release from house arrest.

Stewart last month asked her sentence be cut by four months from her scheduled August release or that terms of her detention be relaxed and her electronic ankle tracker be removed, CNN/Monday reported.

Judge Miriam Goldman Cedarbaum Monday agreed with prosecutors who argued Stewart's sentence was lenient and fair, CNN/Money reported.

Stewart, 63, was sentenced to five months in prison followed by five months house arrest for her conviction of lying about a stock sale. Stewart received the lightest sentence possible under federal guidelines.

Her appeal of her conviction is still pending, with a ruling possible sometime this month.

Come on, Martha.  House arrest has got to be better than prison.  Look at the bright side, you don't have to smuggle spices into your own house.   C~H~K

lol...  I think that's considered contra band (in a prison anyway).

Martha Stewart's conviction upheld

January 6, 2006: 12:31 PM EST

NEW YORK (CNNMoney.com) - A federal appeals court Friday upheld the conviction of celebrity style setter Martha Stewart for lying about a stock sale.

In 2004, Stewart was convicted on charges of conspiracy, obstruction of justice and making false statements. Her former Merrill Lynch stockbroker, Peter Bacanovic, was convicted on four of five counts against him.
 
An appeals court upheld Stewart's conviction for lying about a stock sale.
 
Stewart served five months in prison and five months, three weeks of house arrest beginning in October 2004. The charges stemmed from Stewart's sale of almost 4,000 shares of ImClone Systems stock in late 2001, just before the shares tumbled following a negative FDA ruling about the cancer drug Erbitux.

The decision by the U.S. Court of Appeals for the Second Circuit in New York affirms that her conviction will not be overturned. But the court also ruled that Bacanovic's sentence could be reviewed.

"We conclude that none of the numerous grounds upon which defendants challenge their convictions provides a basis to disturb the jury's verdict and, therefore, we affirm the judgments of the District Court, and remand the case solely for consideration of whether to modify Bacanovic's sentence," the appellate court said in its ruling.

Stewart was released from house arrest last August

Pretty smart of Martha to go ahead and get that pesky sentence served instead of sitting back and
awaiting the outcome of her appeal, lol.
